Renting out a property in Delhi is set to become more regulated, as the government has introduced new guidelines for landlords. Following a high-level meeting between Chief Minister Rekha Gupta and Home Minister Amit Shah to address the rising crime rate in the city, Delhi Police has announced stricter rules for property owners.
These guidelines are particularly important for landlords who rent their properties to foreign nationals. Delhi Police has explicitly stated that failure to comply with these rules will result in legal action against landlords.
Mandatory Notification Within 24 Hours
As per a Delhi Police spokesperson, landlords must inform the Foreigners Regional Registration Office (FRRO) about the arrival of foreign tenants within 24 hours. This measure aims to enhance national security and ensure compliance with legal requirements. Additionally, landlords must provide complete details of their foreign tenants to the local police station for background verification.
They are also required to maintain a ‘Form B’ register, which should be readily available for inspection by police authorities.
Consequences of Non-Compliance
Delhi Police has highlighted that several landlords have previously neglected to report the stay of foreign tenants to the FRRO. Under the Foreigners Act, Foreigners (Amendment) Order, 2016, and Foreigners (Amendment) Rules, 2016, it is compulsory to submit this information within 24 hours.
With an increasing number of foreign nationals being linked to criminal activities in Delhi, particularly drug smuggling, authorities have warned of strict legal repercussions for non-compliance.
Submission of Tenant Details via Form C
Landlords are required to submit all necessary details of their foreign tenants using Form C. This form can be filled and submitted either online or in person at the FRRO office.
